Johnathen Thacker bound over for arraignment in murder case

February 21, 2013

Johnathen Thacker, accused murderer of Briana Ault, appeared in district court for preliminary hearing today.

Johnathen Don James Edward Thacker, 23, of Fort Smith, Ark., appeared in front of Special Judge Jeff Singer today for preliminary hearing for first degree murder.
Thacker is accused of taking part in the murder of Braina Ault on Sept.12, 2010. Ault was 22-years-old at the time of her death.
Thacker and his brother, Elvis Thacker, have been charged with first degree murder and forcible sodomy in connection with Ault's death.
District Attorney Jeff Smith and Assistant District Attorney Marion Fry were present on behalf of prosecution. Thacker's defense team consisted of Bobby Lewis and Gary Henry with the Oklahoma Indigent Defense System.
Two witnesses took the stand for the state, a previous cellmate of Thacker's and Oklahoma State Bureau of Investigation Special Agent Shawn Ward.
The defense called no witnesses during the preliminary hearing.
Singer found sufficient evidence had been presented that Thacker had committed a crime and bound over Thacker for District Court Arraignment on March 13, at 1:30 p.m.
