Jury trial begins in county lawsuit

July 16, 2012

Former deputies have their day in court seeking unpaid wages from 2006.

Former LeFlore County Deputies Burell Shipman and Dale Fout filed a lawsuit against the LeFlore County Board of County Commissioners in 2006. On Monday a jury was picked and the trial began.
Shipman and Fout allege in their petition against the commissioners they were owed payment for compensation wages and holiday pay. They claim Sheriff Roy Gentry approved the payments but when the payroll warrant was submitted to the commissioners, it was denied.
The two are seeking in excess of $30,000 each in back wages.
The commissioners named as defendants in the case are Carol Rogers, Lance Smith and Freddy Cox.
Court is scheduled to resume at 9 a.m. today in Associate District Judge Ted Knight's courtroom.

Leflore Co. residents

Every Leflore County resident should be outraged over this lawsuit. First because of the excessive hours the deputies needed to work to protect the county. Second because the good old boy network was in full swing with hearsay and word of mouth being used to conduct official county business. How in the 21st century, any business or government entity can attempt to operate without a written and clearly defined compensation policy for any employee much less deputies is beyond me. Every resident should contact the county clerk to inspect the policies concerning county employees. The county should be able to back up every regulation and policy in writing. Saying "It has always been that way." obviously does not hold water in a court of law.
