Monday's County Commissioner meeting minutes

November 10, 2011

LeFlore County Commissioners meet every Monday at 9 a.m. at the LeFlore County Courthouse.

ACTION OF THE BOARD
OF COUNTY COMMISSIONERS

The Board of County Commissioners, LeFlore County, State of Oklahoma, met in a Regular Business
Meeting on November 7, 2011 at 9:00 a.m. with Chairman Lance Smith presiding. Also present were Vice-Chairman Derwin Gist, Member Cebern Scott, County Clerk Kelli Ford and Assistant District Attorney Marion Fry.

The following action was taken by the board:

(1.) Chairman Lance Smith called meeting to order.

(2.) Motion was made by Lance Smith and seconded by Derwin Gist to approve the minutes of October 31, 2011. Motion was approved all voting yes.

(3.) Motion was made by Lance Smith and seconded by Derwin Gist to approve purchase orders
presented. Motion was approved all voting yes.

(4.) Motion was made by Lance Smith and seconded by Derwin Gist to approve a bond for Angie
Moody, Treasurer, Fanshawe School. Motion was approved all voting yes.

(5.) Motion was made by Lance Smith and seconded by Derwin Gist to approve October monthly fee
reports for the Court Clerk, Assessor and Board of County Commissioners. Motion was approved
all voting yes.

(6.) Motion was made by Lance Smith and seconded by Derwin Gist to approve transfer of approp-
riations for the County Assessor from H-1A (Personal Services) $1700.00 into H-1C (Travel);
for the Highway Fund from T-2 (M & O) $11904.59 into T-1A (Personal Service); for OSU
Extension Office from E-1A (Personal Service) $5715.00 into E-2 (M & O); for Whitesboro Fire
Department from FDWHI-2 (M & O) $500.00 into FDWHI-3 (Capital Outlay); for Wister Fire
Department (Rental/Lease) $5300.00 into FDWIS-2 (M&O). Motion was approved all voting yes.

(7.) Blanket purchase orders were approved as on file in the office of the LeFlore County Clerk.

(8.) Old business. None discussed.

(9.) Current bridge and road projects. None discussed.

(10.) Burn ban. No discussion.

(11.) After reviewing bids, motion was made by Lance Smith and seconded by Cebern Scott to reject all bids due to lack of financing options being received for lease/purchase of County Assessor trucks. Motion was approved all voting yes.

(12.) After recommendation from Consolidated Rural Water District #1, motion was made by Lance Smith and seconded by Derwin Gist to accept bid from Spider Webb Farm Implements for purchase of compact excavator (partial funding provided by 2011/2012 REAP Grant). Motion was approved all voting yes.

(13.) Discussion was held about selection of newspapers publications for fire departments bids. Spiro
Graphic Reporter Jim Fineup presented the board with documents to support his objection of all bids being published in one newspaper. Assistant District Attorney Marion Fry addressed Fineup's comments stating that it's up to whom is responsible for advertising county publications. After discussion, motion was made by Derwin Gist and seconded by Cebern Scott to publish bids in whichever district the fire department is located. Motion was approved all voting yes.

(14.) The board opened lone bid for lease/purchase of new truck and tools to benefit Spiro Fire
Department. Motion was made by Lance Smith and seconded by Derwin Gist to move item for
discussion after item #21 on agenda to allow Spiro Fire Department Representatives time to
review. After recommendation was presented, motion was made by Derwin Gist and seconded by
Cebern Scott to accept bid from Chief Fire & Safety, Co., Inc. Motion was approved all voting
yes.

(15.) Opened bids for Election Board 13 month ballot printing contract. Motion was made by Lance
Smith and seconded by Derwin Gist to table item, allowing Election Board time to review.
Motion was approved all voting yes.

(16.) Motion was made by Lance Smith and seconded by Derwin Gist to approve resolution
determining maximum monthly highway expenditures. Motion was approved all voting yes.

(17.) Motion was made by Lance Smith and seconded by Derwin Gist to approve proclamation
declaring November 10, 2011 as LeFlore County "Winter Weather Preparedness Day". Motion
was approved all voting yes.

(18.) Motion was made by Lance Smith and seconded by Derwin Gist to approve annual agreement between the Oklahoma State University Cooperative Extension Service Office and LeFlore County. Motion was approved all voting yes.

(19.) Motion was made by Derwin Gist and seconded by Cebern Scott to approve lease/purchase agreement between Empire Financial-Capital Equipment Financing and LeFlore County for Hogeye Fire Department skid unit. Motion was approved all voting yes.

(20.) Reviewed 6-month vendor bid list for county highway materials.

(21.) Motion was made by Lance Smith and seconded by Cebern Scott to approve Treasurer's Monthly Report of Officers. Motion was approved all voting yes.

(22.) Motion was made by Lance Smith and seconded by Derwin Gist to enter into Executive Session with Attorney Tim Melton and Assistant District Attorney Marion Fry re: Burrel Shipman & Dale Fout vs. Board of County Commissioners, County of LeFlore Oklahoma, Case No. CJ-2006-629. Motion was approved all voting yes.

(23.) Motion was made by Lance Smith and seconded by Cebern Scott to exit Executive Session and return to regular meeting. Motion was approved all voting yes.

(24.) The board decided to take no action as result of Executive Session.

Motion was made by Lance Smith and seconded by Derwin Gist to adjourn and reconvene at 9:00 a.m. on November 14, 2011. Motion was approved all voting yes, Smith-yes, Gist-yes, Scott-yes.
