Murder trial stays on track

The trial date set for one of two brothers accused in the murder of 22-year-old Briana Ault in 2010 remains on schedule to begin in June.
Ault's body was found in a Pocola pond on Texas Road near the Oklahoma,Arkansas state border.
Johnathen Don James Edward Thacker, 25, of Cedarville, Ark., appeared before LeFlore County District Judge Jon Sullivan during a status hearing Friday afternoon. Thacker was present with his Oklahoma Indigent Defense System attorney Gary Henry, who raised a possible issue with the June date as he says he is still waiting to receive video recordings of his clients arrest in Arkansas.
LeFlore County District Attorney Jeff Smith said he was working on obtaining any additional videos from Thacker's arrest be released to his office.
Due to the possibility all evidence may not be in the hands of the defense in time to prepare for the June jury trial, Sullivan ordered a discovery hearing on March 20. If Henry has what he needs, court will proceed, if not, a new court date may be set.
