Preliminary hearing in murder case continued until October

There will be a two-month delay between testimony in the preliminary hearing of accused murderer Elvis Aaron Thacker.
Thacker, 25, and his brother, Johnathen Don James Edward Thacker, 24, are charged with first degree murder in the death of Briana Jane Ault, 22, whose body was found in a pond near Pocola on Sept. 13, 2010.
On Thursday, criminal proceedings began at 9 a.m. with a brief delay in regard to a motion to suppress requested by Gretchen Mosley, Thacker's defense attorney. Mosley also told the court her assistant was preparing the paperwork for a continuance after she learned none of the Arkansas officers would be at court. Mosley said the Sebastian County Prosecuting Attorney notified her before court he felt the supeona service had not been done correctly and he had advised the officers not to appear at court. Special Judge Jeff Singer ruled the hearing would proceed under Mosley's recognized objection.
Testimony was heard from Oklahoma Bureau of Investigation Agent Shawn Ward and Fort Smith Emergency Medical Services Medic Veronica Harris.
After hours of testimony Singer called the day to a halt at about 4 p.m. and ordered testimony be resumed on Oct. 23.
