Talley walks; jury says not guilty

January 15, 2014

A LeFlore County jury returned a verdict of not guilty on both counts in the Heath Wayne Talley child abuse trial Wednesday afternoon.
A little after 4 p.m., a jury of seven women and five men who had been in deliberation for about two hours returned to the court room to announce their verdict.
Talley was arrested July 10, 2012, after a 22-month-old child in his care was treated for electrical burns and an injury to her genital area. Talley was charged with child abuse by injury and child sexual abuse of a child under the age of 12.
The trial started Tuesday morning and continued through noon Wednesday before Assistant District Attorney Margaret Nicholson rested her case.
Defense attorney Gary Buckles told the court Talley would not take the stand to testify nor would any other defense witnesses.
