Heavener dispatcher surrenders

Charged with 21 counts

Heavener dispatcher and reserve police officer Trena Nixon turned herself in to authorities on Friday and has been charged with with 21 counts of obtaining a controlled substance by fraud.   She was arrested outside the courthouse on June 26 at approximately 5 p.m. and bonded out later that night.
In the affidavit filed in the LeFlore County Court Clerk's Office, an agent with the Oklahoma State Bureau of Narcotics and Dangerous Drugs Control (OSBN) wrote that between Jan. 2, 2008, and Sept. 28, 2008, Nixon attained prescription drugs by fraud.  Court records state that on Oct. 15, 2008, the OSBN received information that Nixon, who was at that time a licensed Practical Nurse (LPN) at the Family Medical Clinic in Poteau, had been calling in prescriptions for the controlled drugs Hydrocodone and Propoxyphene to local pharmacies. She was calling the prescriptions in for herself and under the names of her husband, Heavener Police Officer Kevin Nixon, her brother Aaron Mize.  According to the affidavit the prescriptions were not authorized by the doctors whose names were used on the prescriptions. 
 
“During the course of the investigation I learned that on approximately 21 occasions unauthorized prescriptions for controlled drugs had been called in to local pharmacies,” stated the OSBN agent. Most of the prescriptions had been filled at the Walmart pharmacy in Poteau while others were filled at D&D Pharmacy in Poteau. Court records indicate that that alleged fraudulent activity began Jan. 2 with a call to the Walmart pharmacy for Hydrocodone using Mize's name.
 
The fraudulent activity reportedly continued as follows.
Jan. 17: Mize; Hydro-codone, Walmart.
Jan. 21: T. Nixon; Propoxyphene, Walmart.
Jan. 28: K. Nixon; Hydrocodone, Walmart.
Feb. 10: K. Nixon; Hydrocodone, Walmart.
Feb. 21: Mize; Propoxyphene, Walmart.
Feb. 21: T. Nixon; Hydrocodone, Walmart.
Feb. 27: K. Nixon; Hydrocodone, D&D.
March 12: Mize; Hydrocodone, Walmart.
March 19: Mize; Hydrocodone, Walmart.
March 28: K. Nixon; Hydrocodone, Walmart.
April 20: Mize; Hydrocodone, Walmart.
May 7: K. Nixon; Hydrocodone, Walmart.
May 13: K. Nixon; Hydrocodone, Walmart.
May 24: K. Nixon; Hydrocodone, Walmart.
June 7: K. Nixon; Hydrocodone, Walmart.
June 18: K. Nixon; Hydrocodone, Walmart.
June 24: K. Nixon; Hydrocodone, Walmart.
June 29: K. Nixon; Hydrocodone, Walmart.
Sept. 14: K. Nixon; Hydrocodone, Walmart.
Sept. 28: K. Nixon; Hydrocodone, Walmart.
Nixon remains employed as a dispatcher in Heavener. When contacted, Heavener Police Chief Ty Armstrong, stated that his office had sought legal advise concerning the situation and Nixon's continued employment. Armstrong stated that he had been told she could remain as a dispatcher. However, Armstrong added that she has has been suspended from the reserve program pending the completion of the investigation. Nixon's next court appearance is July 9.
