PVIA claims negligence against OG&E |

The Poteau Valley Improvement Authority has filed suit in LeFlore County District Court against OG&E. Dean Warren, PVIA lawyer filed the negligence claim against the electric company which provides service to various counties including LeFlore County.
According to court records, on May 29, 2008 one of the PVIA pumps for the water system quit working and was set for repairs. This left PVIA with one pump to supply raw water to the treatment plant costing $13,023.90. The records state that on July 1, 2008 it was noted that the submersible pump was making a humming noise. The PVIA checked the three phase service being supplied by OG&E and found that there was an imbalance in their service which caused the pump to repeatedly accelerate then decelerate. On July 3, 2008 the second submersible pump quit working and was sent for repairs costing $12,093.95. A crane was rented on both occasions to pull the pumps at a cost of $770 and $924, respectively. The records indicate that OG&E was called and a crew arrived at the site to work July 3, 2008 and July 7. When the work was completed the voltage imbalance no longer existed. However, as stated in the court record, a voltage imbalance will produce a current imbalance which causes unequal forces on the motor and bearing failure. The record states that OG&E has a duty to provide proper service to PVIA. PVIA claims that OG&E was negligent in providing said service and as a result PVIA suffered damage to personal property to the submersible pumps. The resulting damage to was recorded as $26,811.85. PVIA is asking for $28,811, which covers repairs, court costs and other costs associated with the suit. |
