Title: Choctaw Nation of Oklahoma: Project to include the expansion of four (4) Food Distribution Center Warehouses located in Broken Bow, Durant, McAlester and Poteau, OK. The Choctaw Nation has been awarded the Food Distribution Program on Indian Reservations (FDPIR) CARES Act. B. Solicitation: The Choctaw Nation Construction Administration (CNCA) is soliciting proposals from General Contractor companies to perform the construction of the four (4) Food Distribution Center Warehouse Expansions. CNCA will contract with a General Contractor to complete this project. All firms whom qualify as Indian-Owned must provide proper Indian-Owned Documentation and proof of Ownership to CNCA. C. Description of the Construction: Four (4) Food Distribution Center Warehouse Expansions: The General Contractor (GC) will be responsible to perform all scopes of the four(4) Warehouse Expansions to include, but is not limited to: utility relocates, site utilities, earthwork, concrete foundations, slab-on-grade, Ornamental hand rails, structural metal stud framed building with pre-fabricated metal trusses, standing metal seam roofs, insulation, interior finishes, exterior finishes, electrical, HVAC, relocate HVAC, tie into existing structure, transport and installation of Owner provided cooler/freezer, etc. 1.6 LOCATION A. Poteau, OK 74953 1.7 PROPOSAL DUE DATE TIME AND PLACE A. Proposal Due Date & Time: Thursday May 13th, 2021 at 2:00 PM B. Place of Proposals: Choctaw Nation of Oklahoma Construction Administration Offices, 3651 Big Lots Pkwy, Durant, Oklahoma 74701 1.8 POTENTIAL PROPOSERS A. Sealed proposals provided by General Contractors, addressed to the Owner will be received at Place of Proposals until Proposal Due Date & Time. Proposals will be date and time stamped (via the Owner Representative's official date and time stamp clock) and then publicly opened and read aloud at the same date and hour. 1. Opening of Proposals: At the discretion of the Owner, the properly identified proposals received on time will be publicly opened and will be read aloud. 2. Rejection of Proposals: The Owner shall have the right to reject any or all proposals. A proposal not accompanied by a required bid security or by other data required by the Bidding Documents, or a proposal which is in any way incomplete or irregular is subject to rejection. 3. Acceptance of Proposals (Award): It is the intent of the Owner to award a contract to the lowest qualified proposer, provided the proposal has been submitted in accordance with the requirements of the Bidding Documents and does not exceed the funds available. The Owner shall have the right to waive informalities and irregularities in a proposal received and to accept the proposal which, in the Owner's judgment, is in the Owner's own best interests. 3.1 The Owner reserves the right to hold a private Proposal Review Committee Meeting to review all proposals and award a Contract to the most responsive and responsible proposer based on an approved evaluation criteria format. The lowest proposer does not necessarily mean that the contract will be awarded to that proposer. The Choctaw Nation of Oklahoma reserves the right to award a contract to the proposer that presents the Best Value to the Owner based on the Proposal Review Committee Evaluation. B. Proposers will be required to provide Proposal Security in the form of a Bid Bond in the amount of five (5) percent of the proposal amount. Refer to Document 004313 - Bid Security Form for additional information. C. Refer to other bidding requirements described in Document 002113 - Instructions to Bidders and modifications thereto. D. Submit your offer on the Proposal Form provided in the Request for Proposals packet. E. Your Proposal is required to be submitted under a condition of irrevocability for a period of forty-five (45) calendar days after submission. F. The Owner reserves the right to waive any informalities/irregularities and accept or reject any or all bids. 1.9 FEDERAL REGULATIONS AND GUIDELINES - Food and Nutrition Services (FNS) PROJECT REQUIREMENTS A. Notification is given to all parties involved in this Project, that a portion of matching funds (or all funds) for this Project will be provided by the United States Department of Agriculture (USDA), Food and Nutrition Services (FNS) and the Choctaw Nation for the Food Distribution Program on Indian Reservations (FDPIR). B. All written and/or implied Federal Regulations and Guidelines and/or any other related documents shall hereby be made a part of the Contract Documents by reference with the same force and effect as though they were bound herein. Regulatory requirements found in 2 CFR part 200 are applicable to this project. (Specifically parts 200.318 General procurement standards, as well as 200.319 Competition, 200.320 Methods of procurement, 200.321 Contracting with small and minority businesses, women's business enterprises, and labor surplus area firms, 200.322 Domestic Preference for Procurements, 200.323 Contract cost and price, 200.325 Bonding Requirements, 200.326 Contract provisions, 200.212 Sub Awards to Debarred & Suspended Parties (including 2 CFR 180 and Executive Orders 12549 & 12689), 25 U.S. Code 5307(a) Wage and Labor Standards (including 25 U.S. Code 5363?(1)), 48 CFR 52.223-6 Drug Free Workplace, and 48 CFR 52.225 Buy American Act (including 48 CFR 52.225-6)). General Contractor: Indian preference is preferred in order to perform this project. Indian-Owned Firms or Enterprises must provide written documentation indicating that their company is a majority owned Native American company. 1.11 EQUAL OPPORTUNITY FOR BUSINESSES AND LOWER-INCOME PERSONS A. Hard copies of bidding documents can be coordinated and paid for by contractors at a reproduction facility. Electronic copies of bidding documents will be provided to all contractors at no charge by the Owner's Representative. 1.13 QUESTIONS PRIOR TO PROPOSAL DUE DATE A.
